Client terms, website terms, privacy information and cookie information for Sam Marshall Skincare.
These terms apply to consultations, treatments, treatment courses, gift vouchers and in-clinic purchases supplied by Sam Marshall Skincare. By booking or attending an appointment, the client agrees to these terms.
Sam Marshall Skincare is a sole-trader skincare business based in Ormskirk, Lancashire, United Kingdom. Current contact is through the WhatsApp link or number displayed on this website.
Appointments are arranged directly through WhatsApp and are not booked or paid for through the website. An appointment is confirmed when Sam Marshall Skincare has agreed the treatment, date and time with the client.
Clients should arrive on time and follow any preparation instructions provided before treatment. If a client arrives late, the appointment may need to be shortened, changed or rearranged so that later clients are not delayed. The full treatment price may still be payable where the allocated appointment time cannot reasonably be used for another client.
At least 48 hours' notice is required to cancel or rearrange an appointment. Notice should be given through WhatsApp as soon as possible.
If a client does not attend an appointment and has not cancelled it, a £25 no-show charge will be added to the cost of the client's next treatment. Sam Marshall Skincare may require this charge to be paid before another appointment is carried out.
Sam Marshall Skincare understands that genuine emergencies and sudden illness can occur and may use reasonable discretion in exceptional circumstances.
If Sam Marshall Skincare has to cancel or rearrange an appointment, the client will be offered another suitable appointment. Sam Marshall Skincare is not responsible for indirect costs or losses arising from a cancellation, except where the law does not allow liability to be excluded.
A consultation may be required before treatment. The information shown on the website or social media is general information and does not confirm that a particular treatment is suitable for an individual.
Clients must provide complete and accurate information about their health, medical conditions, allergies, medication, pregnancy or breastfeeding, recent procedures and relevant skincare use. Clients must tell Sam Marshall Skincare if anything changes before a treatment or during a course.
Sam Marshall Skincare may decline, postpone, stop or adapt a treatment where this is reasonably considered necessary for the client's safety, skin health or treatment outcome. Where appropriate, the client may be advised to seek medical advice before proceeding.
Sam Marshall Skincare does not treat anyone under the age of 16. A client aged 16 or 17 must disclose their age when enquiring. A parent or legal guardian must be involved in the consultation and provide any consent required before treatment. Some treatments may be restricted to clients aged 18 or over because of product instructions, insurance conditions or professional judgement.
Treatment recommendations are based on the information available at the consultation and the client's skin at the time. Results vary between individuals and no particular result, time frame or improvement can be guaranteed.
Possible effects, downtime, limitations and aftercare will be explained where relevant. The client will have an opportunity to ask questions and must provide informed consent before treatment. Consent may be withdrawn at any time before or during treatment, although the client will remain responsible for treatment already provided and products already used specifically for them.
Skincare treatments are not a substitute for diagnosis or treatment by a GP, dermatologist or other appropriately qualified healthcare professional. Any changing, bleeding, painful or otherwise concerning lesion should be medically assessed.
A patch test may be required for certain products or treatments. Where a patch test is required, treatment cannot proceed until the stated waiting period has passed. A negative patch test does not guarantee that a later reaction cannot occur.
Clients should follow all aftercare and home-care advice, including instructions concerning sun exposure, SPF, active skincare, heat, exercise and other treatments. Failure to follow advice may affect the result or increase the risk of irritation or complications.
The client should contact Sam Marshall Skincare promptly if they experience an unexpected reaction. Urgent or severe symptoms should be referred to NHS 111, a pharmacist, GP or emergency service as appropriate.
The current price will be confirmed before treatment and is payable at the appointment unless another arrangement has been agreed. Prices and treatment menus may change, but a change will not normally affect an appointment already confirmed at an agreed price.
Payment methods accepted by the clinic will be confirmed directly. Any statutory rights relating to payments and refunds remain unaffected.
The price, included treatments, time limit and any special conditions applying to a course or promotional offer will be explained when it is purchased or booked. Promotional prices cannot normally be combined with another offer unless expressly stated.
If a course is stopped because treatment is no longer suitable, the position will be considered fairly in light of the treatments already supplied and the reason the course cannot continue. Nothing in these terms removes the client's statutory rights.
Gift vouchers are valid for six months from the date of purchase unless a different expiry date is clearly stated on the voucher or as part of a particular promotion, including a Christmas offer.
Appointments must be booked and the voucher used before its expiry date. Vouchers have no cash value, cannot be exchanged for cash and should be kept safe. If the requested treatment is unsuitable, Sam Marshall Skincare may allow the voucher value to be used for another suitable treatment or product, subject to consultation and any promotional conditions.
Product recommendations are based on the information given by the client. Clients should follow the instructions supplied and stop using a product if they develop a concerning reaction.
Faulty, damaged or incorrectly supplied products will be dealt with in accordance with the client's statutory rights. Returns of correctly supplied, non-faulty products may be refused, particularly where a product has been opened or used, unless Sam Marshall Skincare agrees otherwise.
Clinical photographs may be requested to assess the skin, plan treatment or monitor progress. The purpose and storage of clinical photographs will be explained as part of the consent process. Photographs will not be used for marketing or social media without separate, specific permission. A client may refuse marketing consent without affecting their treatment.
Clients and practitioners are entitled to a safe and respectful environment. Sam Marshall Skincare may refuse or end an appointment in response to abusive, threatening, discriminatory or inappropriate behaviour. Payment may still be due for treatment already provided or time that could not reasonably be offered to another client.
Any concern should be raised through WhatsApp as soon as possible, with relevant details and photographs where appropriate. Sam Marshall Skincare will acknowledge the concern, review the treatment record and aim to provide a fair response. Raising a complaint does not affect the client's statutory rights.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or breach of the client's statutory rights. These terms are governed by the law of England and Wales. A consumer living elsewhere in the United Kingdom retains any mandatory protections that apply where they live.

This notice explains how Sam Marshall Skincare collects and uses personal information relating to website visitors, enquirers and clients. Sam Marshall Skincare is the data controller for this information.
Sam Marshall Skincare is a sole trader based in Ormskirk, Lancashire, United Kingdom. Privacy questions and requests can be made through the WhatsApp link or number displayed on the website.
Depending on the enquiry or service, information may include:
Personal information is used to respond to enquiries, arrange appointments, assess treatment suitability, provide safe treatments, maintain client records, supply aftercare, take payment, manage vouchers and courses, handle complaints, meet insurance and legal requirements, and protect the legitimate interests of the clinic and its clients.
Depending on the purpose, ordinary personal information is processed because it is necessary to take steps requested before providing a service, to perform the agreement with the client, to comply with a legal obligation, with consent, or for legitimate interests such as managing the clinic, maintaining accurate records, responding to concerns and defending legal claims.
Health information is special-category data. It is collected only where necessary for safe and suitable treatment and is processed with the client's explicit consent and, where applicable, for the establishment, exercise or defence of legal claims. The clinic's consultation and consent process should be read alongside this notice.
When a person contacts Sam Marshall Skincare through WhatsApp, information is also processed by WhatsApp and its associated provider under their own privacy terms. Clients should avoid sending more sensitive information than is necessary. More detailed health information may be collected through the clinic's consultation and consent process.
Information may also be shared where necessary with professional advisers, insurers, payment providers, IT or website providers, product suppliers where an adverse incident must be investigated, healthcare professionals with the client's agreement, or public authorities where disclosure is legally required or necessary to protect someone from serious harm.
Website review submissions are currently processed through a third-party form delivery service before being sent privately to Sam Marshall Skincare. Visitors should not include health or other sensitive information in a website review.
Personal information is not sold. Marketing photographs or testimonials are not published without separate permission.
Some technology providers, including WhatsApp or website service providers, may process information outside the United Kingdom. Where this occurs, the provider's safeguards and privacy terms apply, and Sam Marshall Skincare will use providers and settings considered appropriate for the information involved.
Information is kept only for as long as reasonably necessary for the purpose collected, including the periods needed to provide aftercare, respond to complaints, meet tax and accounting duties, comply with insurer requirements and deal with possible legal claims. Clinical and consent records may need to be retained for several years after the last treatment. Information that is no longer required will be securely deleted or destroyed.
Reasonable organisational and technical measures are used to protect personal information from loss, misuse or unauthorised access. No internet or messaging service can be guaranteed completely secure, so sensitive information should only be sent where necessary.
Depending on the circumstances, a person may have the right to ask for access to their personal information, correction of inaccurate information, deletion, restriction, objection, transfer of certain information, or withdrawal of consent. These rights are not absolute and some records may need to be retained for legal, insurance or clinical reasons.
A request can be made through the clinic's WhatsApp contact. Anyone dissatisfied with how their information has been handled may complain to the Information Commissioner's Office, although Sam Marshall Skincare would appreciate the opportunity to address the concern first.
This privacy notice may be updated when the clinic's services, systems or legal obligations change. The current version will be published on the website with its effective date.
